The correct USPTO form depends on the status of your trademark record. Some cases require a response to an Office Action, some require a petition after abandonment, and registered marks may require renewal or maintenance filings.

Below are common filing types that may apply to abandoned, refused, pending, or registered trademark matters.

Step 01

Petition to Revive

Purpose: Used when a trademark application has become abandoned because a required response, Statement of Use, or extension was not filed on time.

When Needed: If the record shows abandonment and revival may still be available based on the USPTO filing history and deadline rules.

Step 02

Office Action Response

Purpose: Used to respond to USPTO refusals or requirements, including likelihood of confusion, specimen issues, disclaimers, classification problems, and description amendments.

When Needed: If the USPTO issued an Office Action and the application requires a complete response before the deadline.

Step 03

Statement of Use / Extension

Purpose: Used for intent-to-use applications after a Notice of Allowance. A Statement of Use proves the mark is in use, while an extension gives more time if use is not ready.
